e-Music.ca is the Canadian Web Music Alliance Inc., a consortium comprising: mobrien.com; mobrienMusic.com; e-Music.ca; SpiderMonkey.ca; WebRadio.ca; and WebRadio1.net. We are a family internet alliance of mobrien.com (the family internet portal since 1993); WebRadio.ca (the Radio Station); and SpiderMonkey.ca (The Search Engine). We are all-Canadian, located in Canada in the Toronto area. Above all, we are music lovers, like you.

This website's administrators abide by the EU Safe Harbor Framework as outlined by the US Department of Commerce and the European Union and are trained, aware, and abide by all aspects of the Canadian and U.S. Electronic Communications Privacy and Computer Fraud and Abuse Statutes. You can visit web pages at the domain e-music.ca without telling us who you are or revealing any personal information about yourself. No information is gathered about you surreptitiously meaning that we will not use spy cookies nor pop-ups, nor banner ads and the like and in fact we deplore those goofballs who do these things. We make no effort to identify public users of our site except those who are not just public visitors but privileged members. If you say you are a member you must be able to identify and authenticate yourself with a username and password. No identifying data is disclosed to any third party for any purpose whatsoever.

Membership Lists

Who our members are is ours and their business only. We will track the number of times a song title is downloaded so that any consideration due to the artist is a known and proven thing. We will not share personal information with anyone about anyone no matter who they are with the exception of severe violators of our Acceptable Use Policy.

Severe Abusers Waive Privacy Rights

Law breakers waive their rights to privacy. Any person who violates the rights of others including the rights of the site owner or site members puts themselves at grave risk of prosecution and in the event of conviction, a severe loss of their rights including the right of freedom that is lost while incarcerated.

Information about you is received only when you specifically and knowingly provide personal information to us for the purpose of requesting a service strictly for the purpose of enabling us to deliver that service, for example, by email.

ACCEPTABLE USE Customers are heartily welcomed to take advantage of all resources, obtain all reasonable benefit, and full private enjoyment offered them for as long as that use is within "acceptable use policies" and compliant with this site's legal notice. Customers will use their entitled resources and privileges with respect and courtesy to all Internet users and report to NOC or Webmaster any abuses they encounter. BACKGROUND The Internet is intended for use by mature adults (and by minors when supervised by mature adults). Our customers are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. Net abuse, including but not limited to activities such as using a non- existent email return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), trolling (posting outrageous messages to generate numerous responses), mailbombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system. Tortious conduct, including but not limited to posting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights. COPYRIGHTS The user agrees not to violate any copyrights or other rights attached to any file, object, material, picture, image, text, script, audio file or any thing whatsoever found at this site. User Rights -- Downloaded Music Files Our files are for the reasonable possession and enjoyment of the registered purchaser. It is important, however, that these files, once properly obtained, not be inserted into a file sharing regime. This is the controverted behaviour receiving much publicity lately. In such cases both we and the RIAA have a conflict with that controverted behaviour. We are a responsible Canadian company (MPRM Group Limited) owning and operating a range of internet publishing and software distribution properties. It is our contention that obtaining a music file from our servers is the equivalent of visiting a brick and mortar reseller. All site visitor's are invited guests and in context must behave accordingly and abide by Acceptable Use Policies (http://www.mobrien.com/legal.html). No special software is required, only a properly authenticated membership which is provided in the form of a "License" which the purchaser is assigned and receives when paying through our e-commerce process, powered by industry giant Digital River's RegNow system (http://www.regnow.com/). Any files or software downloaded from our internet sites will be the property of the registered (licensed) user (member) for that person's exclusive use. In common law, such files, where the possessor does not also have possession of the original medium (i.e.: a CD), are considered to be under "lease" or "license" without time limit for as long as there are no violations, which assures a set of reasonable "fair use" rights to the registered purchaser. An example of common law fair use would include sharing such resources for personal use within a household BUT NOT placing such files in the wild on the internet through file sharing programs like Kazaa, Morpheus and others of the kind; nor any other form of improper distribution in any medium. All files are tracked from the moment of download. INTEGRITY OF FILE STRUCTURES All files are stored on non-routable backend file servers which feed our front-end web interfaces through secure channels -- in other words they cannot be 'poisoned' by malicious hackers. All user access is provided through double authentication security. All files are polled and scanned regularly for viruses and malware; and then again in real time at transmission to the client computer. NOTICE TO PARENTS REGARDING CONTENT Whereas there is a trend within the music industry to back away from prolific profanity and seditious comment in musical lyric content, we strongly suggest parents nevertheless monitor and discuss with their children any controversial music they entertain themselves with. We do not provide any assurances about the moral content of any artist's creation, and in fact are inclined to advise parents that a thorough education in the use of extreme profanity can be obtained from some musician's body of work. Please be wary of your children's preferences in music content and administer whatever censorship you see fit within your own domain. We are prepared to assist parents in this regard by any reasonable measure available too us. SECURITY Use of secured computer and network facilities requires prior authorization. Unauthorized access is prohibited. Usage may be subject to security testing and monitoring. Abuse is subject to criminal, civil, and extra-legal prosecution.
